Terms and Conditions

1. Scope of Application


1.1. These General Terms and Conditions apply to all contracts concluded between the seller Johanna Tobisch (hereinafter "Seller") and a consumer (hereinafter "Customer")  The inclusion of the customer's own terms are hereby irrelevant, unless otherwise agreed upon.


1.2 A consumer within the meaning of these General Terms and Conditions is any person who concludes a legal transaction for purposes that are predominantly neither their commercial nor their  professional activity.


1.3 Entrepreneur within the meaning of these terms and conditions is a person or legal partnership that, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity.

 

2. Conclusion of contract

2.1 The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog.

 

2.2 The customer can place the seller's products into their shopping cart without obligation, and correct their entries at any time before submitting their binding order. By clicking the order button you place a binding order for the goods contained in the shopping cart.

 

2.3 The seller can accept the customer's offer within five days,

  • by sending the customer a written order confirmation or an order confirmation in text form (fax or email), whereby the customer's receipt of the order confirmation   is decisive.
  • by delivering the ordered goods to the customer, whereby the access of the goods to the customer is decisive,
  • or by asking the customer to pay after placing his order.


If at least one of the aforementioned requirements is fulfilled, then the contract is concluded. If the seller does not accept the customer's offer within the aforementioned period, this is considered to be a rejection of the offer, with the result that the customer is no longer bound by his declaration of intent.

 

2.4 The languages ‚Äč‚Äčavailable for the conclusion of the contract are German and English.

 

3. Delivery & shipping conditions

3.1 The goods are delivered to the address entered by the customer on their order, unless another agreement has been made. 

 

3.2 If delivery to the customer was not possible, the customer bears the costs of the unsuccessful shipment. If the delivery is attempted again, the customer pays all subsequent shipping costs.

 

3.3 In-house pick up of the goods is not possible. 

 

4. Prices and terms of payment

4.1 The stated prices are total prices. 

 

4.2 In the case of deliveries to countries outside of the European Union, additional costs may arise which the seller is not responsible for and which are to be paid by the customer. These include: costs for the transfer of money by credit institutions (e.g. transfer fees, exchange rate fees), import duties, taxes, or customs duties. Such costs can also arise in relation to the money transfer if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.

 

5. Payment

5.1. Payment is possible via PayPal.

 

6. Retention of title

6.1 The goods remain the property of the seller until they have been paid in full.

 

7. Liability for defects

7.1 If the purchased item is defective, a replacement item will be shipped.
